General Terms and Conditions of Sale


These are the terms and conditions based on which BIEPL is willing totrade. These terms apply to all orders – all ready received and all future orders placed by the clients, until further notice from us. Should you wish to negotiate any of the terms stated below please contact us. No changes can be put in place until approved in writing by one of our directors.


We offer goods for sale through our website, our catalogue and our trade centre. Our prices vary from time to time and printed material such as catalogues or advertisements may show the dates when the prices are valid. During the valid period of a catalogue we may offer things at a lower price. This could be a special offer or just an everyday price cut. The prices we quote always exclude GST. This will be charged at the applicable rate.

The prices given are those at the date of quotation. We reserve the right to increase any prices at any time; we do not have to notify the customer until the invoice is issued.

If order numbers are used, these must be supplied at time of order processing as the information is automatically processed.

Delivery and Collection

Transportation of goods is charged on all orders unless otherwise agreed with a senior member of staff. Transportation costs are decided on weight basis. So transportation and delivery must always be requested at the time of quotes.

Delivery dates quoted are estimates only; we do not hold any responsibility for failure to deliver on those dates.
If goods are to be collected, they must be done so within seven days of our notifying you the goods are ready for collection.

If Proof of Delivery is required we may need a least 1 days notice to access the information at peak times.

Authorised Signature on Delivery

Unless we have your written authorisation, we will always require an authorised signature when delivering goods to you. We will not be held responsible for non delivery due to lack of authorised signature.


We will normally dispatch your goods within stipulated time as agreed at the time of deal finalisation. Goods remain the property of Balvika Industrial Equipments Pvt. Ltduntil paid for in full.


Orders once placed cannot be cancelled. If you wish to cancel the order you should do so in writing by email or letter and only upon our confirmation, shall the order be treated as cancelled.

Mistaken Order

We do not hold any responsibility for mistaken orders; it is the customer’s responsibility to make sure all goods ordered are correct at time of processing the order with us.

If at any time an order has to be changed/modified we can make charges for any work done prior to the change.


You are strongly advised to inspect all goods on delivery/collection. We do not accept liability for alleged defects in goods which would have been apparent on such an inspection unless the claim is notified to us within 7 days of delivery/collection.

You must, if required by us, return goods to us for a full inspection. Once the inspection has been carried out you will be notified of the outcome, either in writing or by verbal telephone conversation.


If a product is returned to us a full refund will only be given at our sole discretion, and only once a full inspection of the goods has been completed to make sure they are not damage or have been used.

Goods Examination Report

All Reports of Thorough Examination are supplied with applicable goods and are packed with all goods at time of shipping, these should be then correctly stored when goods are received.
If a copy of any information such as invoices or Report of Thorough Examination is required we may charge for any time taken to gather this information.

Storage Charges

Storage charges can be made at peak times when storage space is needed.


If any of the goods we supply fails to perform satisfactorily please notify us immediately. One of our trained engineers will carry out a thorough inspection and examination. If we agree that there is a warranty claim we will carry out any repair and return the goods to you in asshort a time as possible. Should the item be not covered under warranty, we will send you a written quotation for the repair.

We are not liable for loss of business by you due to a product failure. Some of the goods we sell carry longer manufacturer’s warranty.Our guarantee is intended to give you additional peace of mind and not a substitute for the manufacturer’s warranty.

Unforeseen Circumstances

Where things like strikes, wars, acts of terrorism or even small things like power cuts interfere in our business with you, we will do our best to keep things going. We shall have no liability to you for any failure which is due to such unforeseen circumstances or any other situation outside our control.

Age Restrictions

Age restrictions apply to the supply of some goods. By ordering these goods you confirm that you are over 18 and that the person receiving the delivery is also over 18.

Our Mistakes

We are constantly updating our products prices and offers. We are confident of our technology and staff but acknowledge that human error is always possible. If goods are offered for sale incorrectly we will always try to honour our offer. There may be rare circumstances where it is not possible for us to do so. In such cases we will contact you and explain the situation, if we are unable to resolve the matter fairly with you we reserve the right to refuse your order and refund any payment you may have made.


Your payment is due to us along with receipt of order unless otherwise stated at time of order taken. If payment is not received by this date, we may do any or all of the following:-

– Suspend or cancel our obligations under this or any other contract.

– Charge interest on any overdue invoices from the date of invoice to the date of payment

– Exercise any other rights to us under the contract (including repossession of goods as stated in clause 9)

– Review your credit limit with us

The goods specified under this contract remain the property of Balvika until full payment is received for any invoices in respect to the goods in question.


We provide credit accounts to a limited number of Corporates, Schools, Local Authorities p.l.c. companies & Government funded establishments under separate Terms of Business. (see below)

These terms are set out by Balvika Industrial Equipments Pvt. Ltd (BIEPL). We reserve the right to change the above at any time without giving prior notice but once done so a new agreement will be issued to all parties concerned.
